EvMak Tanzania Limited (“EvMak”, “we”, “us”) is licensed by the Bank of Tanzania to provide regulated payment services.
These Terms apply to any person (“User”, “you”) making payments through EvMak using:
By completing a transaction through EvMak, you agree to these Terms.
1. ROLE OF EVMAK
1.1 EvMak acts as a regulated payment processor facilitating transactions between Users, financial institutions, mobile money operators, and merchants.
1.2 EvMak is not the seller of goods or services. The merchant remains solely responsible for delivery, quality, and performance.
1.3 All funds received may be placed on temporary hold for up to 24 hours for reconciliation, fraud monitoring, and settlement purposes.
2. AUTHORIZATION & TRANSACTION PROCESSING
2.1 A transaction is considered authorized once:
- The issuing bank approves the card transaction; or
- The mobile money wallet confirms PIN authentication; or
- Google Pay / Apple Pay authentication is successfully completed.
2.2 EvMak reserves the right to cancel, block, or suspend a transaction after authorization if:
- Fraud is suspected
- Regulatory requirements apply
- System anomalies are detected
- The transaction violates these Terms
2.3 Partial payments are permitted where supported by the merchant.
3. RECONCILIATION & FAILED PAYMENTS
3.1 If a User is debited but the merchant reports a failed transaction:
- The transaction will enter reconciliation review.
- Reconciliation timeline: up to 24 hours.
3.2 If reconciliation confirms failure and merchant approval is received, a refund may be processed.
3.3 In cases of network timeout, refunds may be processed upon merchant confirmation.
3.4 EvMak may automatically refund certain failed transactions without requiring a request.
4. REFUNDS
4.1 Users may request a refund through EvMak; however, EvMak will first contact the merchant for confirmation.
4.2 Refund approval is subject to merchant confirmation and transaction validation.
4.3 Expected refund timeline: Up to 72 hours, excluding bank or telecom processing delays.
4.4 Refund processing fees may apply and may be deducted from the refund amount where disclosed.
4.5 EvMak does not guarantee refunds where:
- Merchant declines the refund
- The transaction was properly authorized
- The request violates merchant refund policy
5. CARD DISPUTES & UNAUTHORIZED TRANSACTIONS
5.1 If a User claims their card was used without authorization:
- The matter must be reported to the issuing bank.
- The issuing bank will handle the dispute under card scheme rules.
5.2 EvMak may notify the merchant and provide transaction records.
5.3 EvMak reserves the right to block Users involved in suspected fraudulent activity.
5.4 Fraudulent use of chargebacks may result in permanent restriction from using EvMak services.
6. MOBILE MONEY PAYMENTS
6.1 Mobile money transactions require confirmation via the User’s wallet PIN.
6.2 EvMak does not collect, store, or process mobile money PINs.
6.3 Transactions will not complete without wallet confirmation.
6.4 Mobile money reversals may be processed subject to telecom operator policies.
7. GOOGLE PAY & APPLE PAY
7.1 Wallet transactions rely on device-level authentication provided by Google or Apple.
7.2 EvMak does not store wallet credentials.
7.3 Authorization decisions are made by the underlying issuing bank.
8. FRAUD PREVENTION & SECURITY
8.1 EvMak uses fraud monitoring and transaction screening systems.
8.2 EvMak may:
- Block suspicious transactions
- Suspend User access
- Report fraudulent activity to the Bank of Tanzania or relevant authorities
8.3 EvMak logs technical information including IP address and device metadata for security purposes.
9. DATA PROTECTION
9.1 EvMak does not store full card numbers or CVV codes.
9.2 EvMak may store tokenized references, transaction metadata, and IP addresses.
9.3 Data may be shared with:
- Acquiring banks
- Card networks
- Mobile network operators
- Regulatory authorities where required by law
10. FEES
10.1 Users may be subject to:
- Bank charges
- Mobile money operator fees
- Currency conversion charges
10.2 Refund processing fees may apply.
11. LIMITATION OF LIABILITY
11.1 EvMak shall not be liable for:
- Merchant failure to deliver goods/services
- Bank or telecom downtime
- Declined authorizations
- Delays caused by third-party institutions
11.2 EvMak’s maximum liability shall not exceed the value of the transaction in dispute.
11.3 EvMak shall not be liable for indirect, incidental, or consequential damages.
12. USER CONDUCT
Users agree not to:
- Use stolen payment credentials
- Attempt fraud or unauthorized transactions
- Interfere with system operations
- Abuse dispute or refund processes
Violation may result in permanent suspension.
13. REGULATORY COMPLIANCE
EvMak is licensed and regulated by the Bank of Tanzania and operates in accordance with applicable Tanzanian laws and payment regulations.
Users may escalate unresolved complaints in accordance with regulatory procedures after first contacting EvMak support.
14. AMENDMENTS
EvMak reserves the right to amend these Terms at any time. Continued use of the payment service constitutes acceptance of updated Terms.
15. GOVERNING LAW
These Terms are governed by the laws of the United Republic of Tanzania.
